UPC Webinar Series – Substantive Case Law on Patent Validity before the Unified Patent Court
Two years into the operation of the Unified Patent Court (UPC), a coherent body of case law on patent validity is beginning to take shape. Building on this momentum, epi is offering a three-part autumn webinar series dedicated to core aspects of substantive UPC law, as far as it relates to patent validity, presented by Tilman Pfrang, European patent attorney and UPC representative, and Andrea Perronace, European patent attorney and technically qualified judge at the UPC.
This structured series will guide European patent practitioners through the legal standards and recent case law concerning the validity of European patents before the UPC. Designed for day-to-day practice, the webinars provide practical insights and comparative commentary with EPO and national jurisprudence.
-
Session 1 will focus on claim interpretation and novelty: How does the UPC read a patent claim? What role do the description and figures play? How does the UPC read the prior art?
-
Session 2 addresses inventive step: Does the court adopt the EPO’s problem-solution approach, or is it shaping a distinct methodology? What does current case law suggest about starting points and technical problems?
-
Session 3 deals with added matter, clarity, and sufficiency: How rigorously is the “gold standard” applied? What are the standards in relation to clarity in case of amended claims? What do recent decisions say about sufficiency of disclosure?
Each session lasts one hour and includes references to relevant decisions and legal sources, making the series both a strategic update and a litigation-ready toolkit.
